EUDR – CBAM

Regulation (EU) 2023/1115 on commodities and products associated with deforestation and forest degradation (the “EUDR Regulation”)
  • It aims at avoiding that certain commodities and products derived therefrom, listed in Annex I of the Regulation itself, are placed or made available on the EU market if they contributed to deforestation or forest degradation.
  • Provides for due diligence obligations that include data collection, risk assessment and mitigation phases.
  • Large and medium-sized enterprises must comply by 30 December 2025, while small and micro enterprises have until 30 June 2026.
Regulation (EU) 2023/956 establishing a carbon border adjustment mechanism («CBAM Regulation»)
  • It impacts certain products imported into the EU and belonging to the following macro-categories: iron and steel, cement, fertilizers, aluminum, electricity, hydrogen.
  • Financial, reporting, certification and data communication obligations relating to emissions incorporated in goods imported into the EU.
  • On 1 October 2023, the CBAM entered into force in its transitional phase. The definitive period will enter into force from 1 January 2026 with additional obligations for the operators concerned.
