  • Organization of the collection, preparation for reuse, recycling and recovery of waste from textile products, including through collective or individual management systems;
  • Provision of suitable financial and organizational means to create a textile waste collection network covering the entire national territory.
National Consolidated Environmental Act (Legislative Decree 152/2006 – “Testo Unico Ambiente”)

The provision of an extended producer responsibility regime was introduced in Italy by articles 178-bis and 178-ter of the Consolidated Environmental Act (Legislative Decree 152/2006). The extended producer responsibility regimes in individual sectors will be established with specific ministerial decrees.

In this regard, a draft decree of the Ministry of the Environment and Energy Security (MASE) regulating the EPR in the textile sector has already been published.

Regulation (EU) 2025/40 on packaging and packaging waste
  • It establishes environmental sustainability and labelling requirements for packaging.
  • Provisions concerning extended producer responsibility, prevention of packaging waste, as well as collection and treatment, including recycling, of packaging waste.

  • It provides, inter alia, specific obligations for producers and users of packaging, including the achievement of the final objectives of recycling and recovery of packaging waste; the correct and effective environmental management of packaging and
    waste relating to their products in proportion to the quantity of packaging placed on the national market; the management of packaging labelling; membership in the National Packaging Consortium (i.e. CONAI) and payment of the related environmental contribution. It also imposes a ban on landfill disposal of packaging, with some exceptions.
National Electronic Register for Waste Traceability (RENTRI)– Art. 188 bis Consolidated Environmental Act
  • Rules for the management and traceability of industrial waste;
  • Need to digitally record in the National Electronic Register for Waste Traceability (RENTRI), waste produced.
  • Active sicne 15 December 2024;
  • The obligations provided depend on the type of activity and the size of the company.
Basel Convention on the Control of Transboundary Movements of Hazardous Wastes
  • Union implementation through Regulation (EU) 2024/1157 on shipments of waste.
  • Controls on shipments of waste based on the origin, destination and route of shipment, the type of waste (including certain plastic and textile waste) and the type of treatment to be applied to the waste at the place of destination.
  • Regulation entered into force on 20 May 2024.
  • Possible updates expected by 2025 concerning, in particular, textile waste.
Washington Convention on International Trade in Endangered Species of Wild Fauna and Flora («CITES Convention»)
  • The main objective of the Convention is to ensure that, when permitted, the international commercial exploitation of wild fauna or flora species occurs in a sustainable manner.
  • The derived Community and national regulations entail additional burdens and restrictions on the trade of products derived from fauna and flora protected by the Convention.

  • In Italy, the crimes related to the application of the Convention and the EU implementing regulations are governed by Law 7 February 1992 n.150.
